Senate Passes False Claims Bill

The Senate passed legislation that would authorize individuals to sue health care providers on behalf of the State by a vote of 37-8.

The bill, SB 279, was amended in committee to address some of the concerns of opponents, including:

     
  • Clarification that “knowingly” submitting a false health claim for reimbursement to the state does not include a mistake or negligence.
  •  
  • Clarification of the maximum damages that can be imposed under the bill.
  •  
  • Mandatory dismissal of a case if the state decides not to intervene and proceed with the action.

The Maryland Chamber remains opposed to the bill as we believe it will generate needless lawsuits against health care providers. Enforcement of state laws should remain a state responsibility.

The bill now moves to the House Judiciary and Appropriations Committees.
