Court of Appeals to Review Arbitration Ruling

The Maryland Court of Appeals recently agreed to hear a case regarding the submission of disputes to arbitration. This is a cause of concern to the business community as many commercial contracts provide for arbitration rather than litigation of disputes. In the case of Future Care v. Addison, the Maryland Court of Special Appeals overturned a Baltimore City Circuit Court decision that had refused to grant a nursing home’s motion to compel arbitration involving a patient’s litigation. View the opinion here (pdf). In granting its writ of certiorari, the Court of Appeals allowed amicus briefs to be filed by the Public Justice Center, AARP, the Legal Aid Bureau and SEIU. The personal injury bar and related groups have pursued nationwide efforts to curtail arbitration and expand opportunities for lawsuits.
