Court Issues Draft Report on Fault Standard
The Maryland Court of Appeals may not change the state’s liability standard to comparative fault by adoption of a procedural rule, according to a draft report issued last week by the Court’s Rules Committee. The Committee’s report also listed numerous legal issues and doctrines that would need to be revised if comparative fault were to be adopted by a court decision.
Court of Appeals Chief Judge Robert M. Bell had requested the Committee to undertake a study of comparative fault several months ago, causing concern for many in the business community. The Maryland Chamber has long opposed efforts to adopt a comparative fault liability standard due to concerns that it would increase litigation, judgments, and insurance rates for businesses.
