Bill Would Impose Sales Tax on Professional Services

House Ways & Means Committee Chair Sheila Hixson has introduced legislation (HB 1051) that would extend the sales tax to 29 additional services, including such business services as tax preparation, management consulting and business consulting, real property management, testing labs, staffing services, drafting, and business brokerage services.

Taxing professional services would make Maryland less competitive. We believe such taxes increase administrative complexity and the cost of compliance. In addition, small businesses would be disproportionately impacted by extending the sales tax to business services, as larger companies can perform many of these services in-house.  Since these activities are not taxed in neighboring jurisdictions, the bill would give those states a competitive advantage in providing those business services.

It may just be me, but it strikes me as curious that lawyers always seem to be exempted from these efforts to tax professional services…

I do not understand why Sheila would submit such a bill. This has been out there before and was proven overwhelmingly to put Maryland at a huge disadvantage with recruiting professional talent and companies into Maryland. Such a reality would cause having to pass on an expense to clients or somehow eating this cost in fear of losing business, a cost that could push many firms over the edge. There would be no reason to keep staffing headquarters in Maryland. As President of the Maryland Recruiters Association, I know that many if not all members would immediately seriously evaluate staying in Maryland.

I hope sense will come back for Sheila and anyone supporting this idea. ANY indepth study will show it’s disastrous actual affect on Maryland business. I only wish they would realize this before scaring the heck out of people.

Can Ms. Hixon do more to make Maryland an impossible place to host small to mid-sized businesses??
