9th Circuit Ruling Conflicts with Wal-Mart Decision

The U.S. Court of Appeals for the 9th Circuit recently upheld a San Francisco “pay or play” ordinance requiring employers in that city to pay specified amounts of health care benefits to their employees or else contribute to the city’s Health Access Program. This ruling conflicts with the decision of the 4th Circuit in the RILA v. Fielder case and could set up an appeal to be decided ultimately by the U.S. Supreme Court.
